Terms and Conditions – Conditions for booking a cigar roller for events

General Terms and Conditions (AGB)

1. Scope of Application
These General Terms and Conditions apply to all services, bookings, orders, and contracts concluded via the domain zigarrenrollerin.de or directly with "Gina Reyes Cigars". This includes, in particular, all inquiries where customers wish to book a cigar roller for events or a cigar seminar.

They apply to both consumers and business entities (entrepreneurs), unless explicitly regulated otherwise.

Consumer: Any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
Entrepreneur / Business Entity: Any natural or legal person or partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of their commercial or independent professional activity.

Deviating or supplementary terms and conditions of business entities shall only become part of the contract if we expressly agree to their validity in writing.

2. Contractual Partner & Conclusion of Contract

For bookings: In the case of inquiries via the contact form, email, or telephone, the offer shall only be deemed accepted once we confirm your booking in writing. This also applies when you reserve a cigar roller for events or schedule a fixed date.
For orders: For orders (e.g., personalized labels, cigar orders if offered), submitting an inquiry does not constitute a binding contract. The contract is formed only upon our written confirmation.

3. Contract Language & Storage of Contract Text
Contract Language: The language of the contract is German.
Storage: Contract texts are not stored by us. You are responsible for archiving booking confirmations or individual agreements yourself.

4. Services & Performance
Our services include, in particular:
- Live cigar rolling at events
- On-site production of freshly rolled cigars
- Personalized cigar labels
- Cigar rolling workshops
- Optional additional services subject to individual agreement

The exact scope of services will be coordinated prior to booking and confirmed in writing. This applies both to booking a cigar roller for events and to planning a cigar seminar.

5. Prices, Travel Costs & Additional Expenses
All prices are subject to additional charges for:
- Travel expenses (depending on distance and effort)
- Material costs (e.g., cigars, tobacco leaves, personalized labels)
- Accommodation costs (if applicable in the case of long event hours or long travel distances)

The customer will receive a transparent quote in advance before booking a cigar roller for events or ordering additional services.

6. Payment
The following payment methods are available:

Advance Payment / Manual Bank Transfer: Bank details will be provided following booking confirmation. Payment is due prior to the event, particularly when a cigar roller has been booked for an event.
Klarna (where available): Processing is handled via Klarna and is subject to Klarna's Terms and Conditions.

Services will only be rendered after full payment has been received.

7. Retention of Title
Individually produced goods (e.g., personalized cigar labels) remain the property of Gina Reyes Cigars until full payment has been received.

8. Cancellations, No-Shows & Rescheduling for Event Bookings

Cancellation up to 21 days before the event date: 80% refund or rescheduling possible.
Cancellation 20 days or fewer before the event date: No refund.
No-show without notice: No refund.
Rescheduling upon request: Subject to availability.
Replacement person: A substitute contact person (e.g., event contact) may be designated.

These rules always apply whenever a cigar roller is booked for events or other event-related services are reserved.

Cancellation by Us:
We reserve the right to cancel an event in the case of unforeseen events (e.g., illness, force majeure). In such cases, a full refund will be issued.

9. Workshops
The same cancellation and operational rules apply to workshops as to events. A substitute participant may attend free of charge.

10. Right of Withdrawal (Cancellation Policy)
For Event/Workshop Services: For services taking place on a fixed date (events, workshops), there is no statutory right of withdrawal pursuant to Section 312g (2) No. 9 BGB (German Civil Code).
For Customized Goods: For individually produced products (e.g., personalized labels), there is likewise no right of withdrawal.

11. Warranty & Liability
Statutory liability for defects (warranty rights) shall apply.

We accept no liability for:
- Damage resulting from improper handling of cigars
- Event procedures/logistics outside our scope of responsibility
- Health reactions to tobacco products (compliance with youth protection laws is mandatory!)

12. Protection of Minors (Youth Protection)
Tobacco products may only be served or distributed to persons aged 18 years and older. Age verification is mandatory.

13. Dispute Resolution
We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board. The European Commission provides a platform for Online Dispute Resolution (ODR).

14. Final Provisions
Applicable Law: For business entities (entrepreneurs), German law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
Severability Clause: Should any provision be or become invalid, the validity of the remaining provisions shall remain unaffected.
Scope: These final provisions apply equally to events where customers book a cigar roller, as well as to workshops or individually agreed services.
